This application is filed for suspension of substantive sentence imposed upon applicant and for bail. Learned counsel for the applicant has submitted that applicant was on bail pending trial and has no criminal antecedents and has prayed for grant of bail. Applicant is found convicted by the learned Special Court for the offence punishable under Section 7 and is sentenced to suffer rigorous imprisonment for two years and to pay fine of Rs.5,000/-, in default to suffer rigorous imprisonment for three months and under Section 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act and is sentenced to suffer rigorous imprisonment for two years and to pay fine of Rs.5,000/-, in default to suffer rigorous Gaikwad RD 1/2

(910)APPA-1290-16 imprisonment for three months. Fine imposed are found duly paid by the applicant. Considering the fact that applicant was on bail pending trial and maximum sentence imposed is of two years, application is liable to be allowed as per order below :

(i) Applicant shall be released on bail on his executing personal bond in the sum of Rs.20,000/- with one surety in like amount.

(ii) While on bail, applicant shall mark his presence with Tembhurni Police Station, District Solapur once in six months pending appeal.

(iii) Applicant shall produce his address to the Tembhurni Police Station and communicate the change, if any.
