1) Heard respective counsel.

2) Counsel for Respondent has opposed the prayer for transfer of the proceedings as according to him, considering the nature of his duties as he is public servant, it will be difficult for him to travel to Mumbai to attend the proceedings. However, he has volunteered to pay travel and out of pocket expenses to the Applicant. 3) The aforesaid contentions are opposed by the counsel for the Applicant on the ground that applicant is not keeping good health and as such, it will not be possible for her to travel to Pune on each 1/2

40.15.22 mca.doc date to attend the proceedings.

4) Considered submissions.

5) Though both children are with the Applicant, they are grown up and taking education. Non-Applicant appears to be a public servant discharging his duties as Police Inspector and as such he was justified in claiming that it will be difficult for him to attend the proceedings at Mumbai. However, in response to Court's query, a statement is made that he shall deposit an amount of Rs. 10,000/- in the pending proceedings viz. Marriage Petition No. 1448/2021, towards travel and out of pocket expenses is accepted as an undertaking to this Court.

6) On each date when the Applicant-Wife physically attend the said proceedings, she shall be entitled to withdraw an amount of Rs. 5000/- towards travel and out of pocket expenses. It shall be the duty of the Respondent to maintain balance of Rs. 10,000/- till final disposal of the Marriage Petition No. 1448/2021. 7) Application as such stands disposed of in the above terms.
