This application under Section 24 of the Code of Civil Procedure (CPC) filed by the wife is for transfer of Hindu Marriage Petition No.104 of 2014 filed by the respondent in the court of Civil Judge, Senior Division, at Ratnagiri, to the Family court at Nashik. The application states that the applicant resides at Nashik and the distance to Ratnagiri from there of 600 kms. avk 1/2
18-MCA-212-2014 At paragraph 7 of the application she states that she "being a lady it is virtually impossible for her to go to Ratnagiri all the way from Nashik to attend the Marriage Petition filed by the respondent." It is, however, admitted by Mr.Sachin Gite, the learned advocate for the applicant, that the applicant is no more residing at Nashik. She has since been residing in Mumbai, where she has taken up an employment. In view of this admission, the only ground taken up in the application, of the distance of 600 kms. between Nashik and Ratnagiri, is no longer available to the applicant. Hence, the application is dismissed.
