Heard learned Counsel for the Applicant and learned APP for Respondent-State.

By this Application, Applicant is seeking relaxation of condition of the order passed by this Court dated 18.08.2023 (Coram : S. M. Modak, J.) Applicant has been released on bail by imposing condition No. (iv) as under:

"The trial Court to accept the surety of Shamimbano only if an amount of Rs. 4,70,000/- is deposited in the trial Court."

It is the contention of learned Counsel for the Applicant that Applicant is not in a position to deposit the said amount hence at present Applicant be permitted to deposit Rs.3,00,000/- and remaining Rs.1,70,000/- would be deposited within two months after releasing from the jail.

Considering the submission of learned Counsel for the Applicant, I pass following Order:

(i) Application is allowed.

(ii) Condition No.(iv) of the order dated 18.08.2023 is modified as under:

"Applicant shall deposit Rs.3,00,000/- before the Trial Court within one week and Applicant shall deposit remaining Rs.1,70,000/- within two months after releasing from jail."

Application is disposed off.
