Today when the matter came up for hearing, the learned counsel for the petitioner submits that this petition may be disposed of by directing the respondents to consider the petitioner's claim in the light of the order passed by this Court in the case of Jyoti Prakash Chougule Vs. State of Maharashtra and Ors.1 . Learned counsel for the petitioner also submits that after Writ Petition No.2354 of 2012 decided on 7th January, 2014.

23-wp-13616.2016.sxw passing of the impugned order dated 16.7.2013, the State Government vide order dated 2.4.2014 (Exh, G) has directed the Deputy Director of Education to consider petitioner's claim but till date no decision has been taken.

Keeping in view the aforesaid, we dispose of this petition by directing respondent no. 3 to consider and take appropriate decision keeping in view the order passed by this Court in the case of Jyoti Prakash Chougule Vs. State of Maharashtra and Ors. (supra). The decision as aforesaid be taken as expeditiously as possible but not later than three months from the date of receipt of copy of this order. While taking the decision, the authority shall not be influenced by the order dated 16.7.2013 Exh. E and shall take a fresh decision in accordance with law. 5.
