CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.638 OF 2015 IN CIVIL REVISION APPLICATION NO.225 OF 2010 Mrs. Dayali Kusumbia Daya .. Applicant

Versus

Mr. Shapoor R. Khareghat .. Respondent Shri. Nitin Mulye, for the Applicant.

None for the Respondent.

CORAM : R.M. SAVANT, J.

DATE : 5th FEBRUARY 2016 P.C.

1.

The above Civil Application has been filed seeking extension of time to file the undertaking in terms of the order dated 5th October 2010 passed in the above Civil Revision Application. The undertaking has been filed by one Mrs. Gayatri Gangadhar Sawant who is the Constituted Attorney of the Civil Revision Applicant as also undertakings have been filed by Mrs. Neeruben Lalchand Kantharia, Mrs. Savitaben Mulchand Rathod and Mrs. Kalpana Chiman Parmar. It seems that the said undertakings were not filed within the time stipulated by the said order dated 5th October 2010. Since the undertakings have already been filed, though belatedly, the delay is required to be condoned and is accordingly BGP.

(904)-CAC-638-15.doc condoned. The Learned Counsel appearing on behalf of the Applicant Shri. Nitin Mulye on the basis of the telephonic instructions states that possession of the premises has already been handed over to the Respondent landlord. In my view, no orders are necessary to be passed in the above Civil Application. The Civil Application is accordingly disposed of.
