Since the offence invoked is under the provisions of 381 which is punishable with an imprisonment less than 7 years, let the Investigating Officer issue a notice under section 41-A of Cr.P.C, in case if he has not already issued the notice. 2.

On receipt of notice, let the Applicant respond to the notice and report to the Investigating Officer within a period of 7 days from today.

Upon his attendance, the Investigating Officer shall follow procedure prescribed under Section 41-A of the Cr.P.C., and record reasons in writing in case he is desirous of effecting arrest of the Applicant.

The Investigating Officer shall give advance notice of 72 hours in case he comes to the conclusion that custodial interrogation of the Applicant is necessary.
