This Bail Application is moved as the applicant/accused is prosecuted for the offences punishable under sections 302, 376(G), 201 r/w section 34 of the Indian Penal Code and under section 3(1)(xii) and section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 in C.R. No.92 of 2016 registered with Baramati City Police Station. One Jaya Kalu Sonawane was raped and killed.

Learned Prosecutor pointed out the order of this Court dated 17.11.2016 which was passed by this Court in Criminal Bail Application No.1561 of 2016 of one Vikas @ Balu Popat Khade 1/2

ba.2151.2016_15.doc who is a co-accused in this matter. In that, the learned Judge has passed the following order:

"1.

The learned counsel for the applicant, after arguing for sometime, upon instructions from the grandfather of the present applicant, seeks liberty to withdraw the application.

2.

Liberty as prayed for is granted in the interest of justice. Application stands dismissed as withdrawn. The learned Sessions Judge, Baramati shall make an endeavour to conclude the recording of evidence, as far as possible within one year from the date of framing of charge.

In view of this, this application is disposed of with liberty to move a fresh application for bail, if the order dated 17.11.2016 is not complied with.
