Learned counsel for the applicant submits that during the pendency of this application, the Supreme Court has delivered a judgment in Tofan Singh vs. State of Tamil Nadu1. He submits that in view of the aforesaid judgment, which is delivered by the Apex Court, post the rejection of the applicant's first bail application, the applicant desires to withdraw the aforesaid application with liberty to file a fresh application in the trial Court in view of the change of circumstance i.e. the judgment rendered in Tofan Singh (supra).
