This Civil Application is taken out for modification of the order dated 9th December, 2010 by which appointments of Arbitrator on behalf of both the sides was made. The modification has become necessary because the learned Arbitrator appointed for the respondents has declined to act as an Arbitrator.

Mr. Walve, learned Advocate appearing for the respondents, states that the respondents desire to appoint Advocate Mr. Sandeep K. Shinde as their Arbitrator. He also states that, Mr. Shinde has agreed to act as an Arbitrator for the respondents. In the circumstance, the order dated 9th December, 2010 is modified to appoint Advocate Mr. Sandeep K. Shinde as the Arbitrator of the respondents and the Civil Application stands disposed off.
