By this Petition under Article 227 of the Constitution of India, petitioner has challenged the order dated 01.08.2016 passed by the learned trial Judge thereby rejecting the application made by the defendant for setting aside no cross order dated 31.08.2015. 3.
Mr. Deshmukh seeks permission to withdraw this Petition with liberty to file application in the trial Court for recalling the order dated 01.08.2016. He submitted that the time spent by the petitioner while prosecuting this Petition from 17.10.2016 till date may be excluded. 4.
On the motion made by Mr. Deshmukh, Petition is allowed to be withdrawn and is disposed of as such. While considering the application for condonation of delay in filing the application for recalling the order dated 01.08.2016, time spent by the petitioner in prosecuting this Petition from 17.10.2016 till date shall be excluded.
