When the matter is called out the Petitioner and her counsel remain absent. The record of the proceeding demonstrate that the learned Advocate Ms. Vidya Gaikwad appearing for the Petitioner made endeavor to get herself discharged from the present proceeding. But the Registry did not allow her to discharge for want of requisite communication. Be that as it may, today also both Petitioner and her counsel remain absent. The matter is pending since year 2016, for determination of validity and propriety of the impugned order dated 20.08.2016 passed by the learned Trial Court under Section 24 of the Hindu Marriage Act. 18.WPST.28985.16.doc In view of attending circumstances on record as well as conduct and demeanour of the Petitioner including attempt to withdraw authority by the learned Counsel appearing for the Petitioner, there is no propriety to keep the present Petition alive for further process. In such circumstances, Petition deserves to be dismissed for want of prosecution. Accordingly, the Petition stands dismissed for want of prosecution. No order as to costs.
