1) It is informed by the learned counsel for the Petitioner that an Application for amendment shall be moved before the Trial Court questioning the re-partition deed.

2) In view of above, Petitioner is granted liberty to withdraw the Petition. Needless to clarify that Petitioner is at liberty to apply for amendment of the Plaint which be decided on its own merits. In case if the prayer for grant of amendment moved by the Petitioner is allowed, in view of change in circumstances, it shall be open for the Petitioner to apply for grant of interim relief.
