This Civil Application is taken out for recalling the self-operating order of dismissal of the Second Appeal dated 4 August 2016 passed by the Registrar (Judicial-II) and for restoration of the Second Appeal by condoning the delay of 67 days.

For the reasons stated in the Civil Application, the same is allowed in terms of prayer clauses (a) and (b), subject to costs of Rs.3000/- to be paid by the Applicant to the Respondent No.1, within a period of three weeks from today.
