Heard the learned counsel for the Applicant and Respondent No.7. Office note shows that Civil Application stood abated against Respondent No.3 Antu Kondiba Kemse, vide order dated 10/02/2015 passed by the Registrar.

This Application is made by the Insurance Company for condonation of 30 days delay in preferring the appeal challenging the award dated 24/04/2014 passed by the MACT, Pune in MACP No.314/2002.

Considering the submissions made by the learned counsel for the Applicant and the Basavraj G Patil 1/2

29.3887.14-caf averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Delay of 30 days delay in preferring the appeal challenging the award dated 24/04/2014 passed by the MACT, Pune in MACP No.314/2002 is condoned.

b) Office is directed to make appropriate noting in the First Appeal stating that the First Appeal stood abated/dismissed against Respondent No.3 Antu Kondiba Kemse.

c) Civil application stands disposed off accordingly.
