P.C:- Civil Application No. 2922/2015 seeks to condone the delay of 10 days in filing he First Appeal against the judgment and award passed by the Special M.A.C.T., Pune in Special M.A.C. No. 8/2007 dated 18th June, 2014. The New India Assurance Company seeks condonation of delay of 10 days and it proceeds to state in the application that the counsel to whom the matter was entrusted by the Mumbai Regional Office, was under impression that the application is filed in time, which was not factually correct and this is the reason for the delay. 2/2 927 caf 2922 of 2015.doc stated in the application appears to be bonafide and in such circumstances, I am inclined to allow the Civil Application. Resultantly, Civil Application No. 2922/2015 is allowed in terms of prayer clause (a). Registry is directed to register the First Appeal and upon registration of the same, issue notice to the respondent, returnable after 4 weeks.
