Heard the learned counsel appearing for the petitioner and the learned counsel for the fifth respondent. An appeal preferred by the petitioner before the Grievance Redressal Committee, Mumbai (Suburb) is fixed on 4th October 2018. On 12th September 2018 while adjourning the Appeal till 19th September 2018, the Grievance Redressal Committee passed ad-interim order of status quo.

The grievance in this petition is that while adjourning the appeal on 19th September 2018, the order of status quo was not extended. The submission of the learned counsel for the fifth

wp10950.doc respondent is that as adjournment was sought by the petitioner on unjust ground, the order of status quo has not been extended. However, we find that no reasons have been recorded for not continuing the ad-interim order of status quo, when there was a prayer made in the application tendered on 19th September 2018.

Considering the pendency of the appeal before the Grievance Redressal Committee, we dispose of this petition by passing the following order: (I) Ad-interim order passed on 12th September 2018 in Appeal No.1070 of 2018 will continue to operate till 4th October 2018;

(II) We make it clear that if the petitioner applies for adjourment on 4th October 2018 and seeks continuation of ad-interim order, the Grievance Redressal Committee shall hear all the parties on the prayer for continuation of ad-interim relief and will thereafter decide the application by recording reasons in brief; (III) All contentions on merits are kpet open;

(IV) Writ Petition is disposed of on above terms.
