This application is preferred by plaintiff for deleting the name of appellant no.1 Fabian Philip Dias, who expired on 14.08.2013.

Considering the submissions made by learned counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application at their cost and consequences.

Hence, the following order.

a) Applicant is permitted to delete the Sneha Chavan 1/2

24 caf 93-14=.doc name of appellant no.1 Mr. Fabian Philip Dias from the cause title of appeal memo as well as pending Civil Applications, if any, at their cost and consequences.

b) Amendment to be carried out within eight weeks from today.

c) Civil Application is disposed of accordingly.
