Learned Counsel for the Petitioner, on instructions, seeks leave to withdraw this petition. He submits that the petitioner intends to file a custody application afresh in the Family Court, Pune, within two weeks from today, and prays that the said custody application be decided expeditiously.

Accordingly, the Petitioner is permitted to withdraw the aforesaid petition with liberty to file an appropriate custody application before the Family Court, Pune. If such an application is filed within two

2/2 3-wp.10735.2019.doc weeks from today, the learned Judge, Family Court, Pune, to decide the same, on its own merits, uninfluenced by the impugned order dated 13th September, 2019, passed by the learned District Judge - 20, Pune, below Exhibit - 89. After the custody application is filed, the learned Judge, Family Court, Pune, is directed to decide the custody application and all interim applications, if filed therein, as expeditiously as possible and preferably within 3 months from the date of filing of the same. 3.

Petition is accordingly disposed of as withdrawn on the aforesaid terms.
