Heard learned Counsel for applicant and learned A.P.P. Applicant is protected by interim order of this Court dated 25.09.2018. Perusal of case dairy would indicate that applicant's involvement is merely on statement of co-accused Manoj Shetty, Manager of Shrushti Lodge, where raid is to be carried out on 27.07.2018 under the provisions of PITA Act. Though it is the case, as stated by learned A.P.P. that applicant is owner of said premises and along with co-accused Manoj Shetty, were jointly running business involving females in prostitution and were sharing their proceeds among themselves with the girls. Said case of prosecution does not appears to be reliable as on perusal of leave and licence Waghmare 1/2
2.ABA.1960.18.doc agreement placed on record it indicates that one Sandeep is the owner of premises which is Lodge and applicant had entered into leave and licence agreement of said Lodge which was valid till 30.04.2018 i.e. much prior to the raid. In that view of the matter, applicant's involvement is not prima facie found in the present crime.
Similarly perusal of F.I.R. would reveal that two victims found involved in this crime are major and as per their statements, they on their own had indulged into prostitution. Said contents are recorded in the F.I.R. lodged by Assistant Police Inspector of Bharti Vidyapith Police Station, Pune. Having considered the overall facts as aforesaid, interim order in force is liable to be confirmed as per order below.
ORDER
Interim order dated 25.09.2018 stands confirmed on same terms and conditions. Application stands disposed of as allowed. (P.N. DESHMUKH, J.) Waghmare 2/2
