Heard learned counsel for the applicant-appellant on this application for bail during pendency of the appeal and suspension of sentence.

The applicant is convicted for the offences punishable under sections 7 and 13(1)(d) read with section 13(2) of Prevention of Corruption Act 1988.

The applicant is sentenced to suffer RI for 4 years and to pay fine of Rs.5,000/- for offence under section 13(1) (d) read with section 13(2) of Prevention of Corruption Act. For offence under section 7 he is sentenced to suffer RI for 3 years and pay fine of Rs.3,000/-. Reportedly both the fine amounts are already paid. During the trial applicant was on bail. According to the case of the prosecution original accused no.2 accepted the bribe amount. He is acquitted by the impugned judgment and order. Apparently present applicantaccused no.1 was not the person who accepted the bribe. Considering these circumstances the present applicant can be released on bail during pendency of appeal. Present application is allowed.

Applicant be released on bail as granted by the trial Court with fresh bond to be executed before the trial Court. 6.
Substantive sentence is suspended till final disposal of the appeal.
