P.C.:- This is an Application filed by the State for modification of order dated 14th August, 2017 thereby, permitting the Respondent Aslam Shabbur Shaikh @ Bunty Jagirdar to attend Ahmednagar ATS Police Chowky on first Saturday of every month, instead of Kalachowky ATS Police Station, till the conclusion of the trial. Heard the learned APP and Mr. Mundargi, the learned counsel for the Respondent. Perused the record. The learned APP submitted that, as a matter of fact there is no ATS Police Chowky at Ahmednagar and there is only one 1/2

ssm 2 38-appp929.17.sxw officce/police station of ATS in Maharashtra situated at Kalachowky, Mumbai and therefore the Applicant may be directed to attend ATS office/Kalachowky Police Station Mumbai on the stipulated dates. Mr. Mundargi the learned counsel for the Respondent submitted that the trial of the present crime has already began and the Applicant is attending the trial regularly.

In view thereof, the original condition imposed upon the Applicant by an Order dated 1st October 2015, passed in Bail Application No. 1719 of 2013 thereby directing him to attend ATS Kalachowky Police Station, Mumbai once in a month on every first Saturday between 11.00 a.m. to 12.00 noon, is hereby restored. The Applicant is hereinafter directed to attend the ATS Kalachowky Police Station, Mumbai on every first Saturday of the month between 11.00 a.m. and 1.00 p.m. till the conclusion of the trial. Application is accordingly allowed.
