31 WP-4813-2019 .doc P.C.:- 1] In continuation of the order dated 10/01/2023 passed by this Court, Counsel for the Petitioner has tendered an affidavit sworn by the Petitioner, thereby stating that Petitioner has expressed his strong regret for the incident as is narrated in the Petition and has further expressed his compassion towards the child for his suffering. He has also assured that he shall be completing his D.Ed. expeditiously and shall submit academic certificate to that effect to the competent authority.

2] Considering the statement made by the Petitioner in the said affidavit, Mr. Desai, Counsel for Respondent No.3 in Writ Petition No. No.4813 of 2019 extends no objection for allowing Writ Petition No.4813 of 2019, particularly having regard to the consent of Respondent No.3 recorded by this Court on 10/01/2023. 3] That being so, Writ Petition No.4813 of 2019 is allowed in terms of prayer clause (a).

4] As a consequence of above, Writ Petition No. 4101 of 2019 and Criminal Application No.449 of 2019 taken out therein do not survive and same stand disposed of.
