1] The learned APP states that the Investigating Officer made an attempt to serve notice under Section 41A of the Cr.P.C. upon the Applicant, but he was not found there.

2] The learned counsel for the Applicant makes a categorical statement that the Applicant is residing on the address mentioned in the title clause of the Application.

3] Let the Investigating Officer serve notice to the Applicant on the said address, within a period of three days from today. Upon receipt of the notice, the Applicant shall report to the Investigating Officer within a period of 7 days thereafter.

(902)ABA-2913-2022.doc 4] The Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C. and record reasons in case if he comes at a conclusion that custodial interrogation of the Applicant is very much necessary for completing the investigation.
