The Petitioner- State has challenged the order dated 20 February 2017 passed by the Maharashtra Administrative Tribunal whereby the Original Application No.1015/2016 filed by the Respondent was allowed.

The Respondent was working as Inspector, State Excise Department in the services of the State. He was placed under suspension by the order dated 18 July 2016. The Respondent challenged the order of suspension by filing aforesaid Original Application in the Tribunal. The Tribunal, by the impugned order,

skn 2 21-WP-1793.2018.doc set aside the suspension order dated 18 July 2016 and directed that the Petitioner be reinstated in service within four weeks. Thereafter this petition was filed on 26 September 2017. The petition has remained pending and has come up in regular course. There is no interim relief sought for or granted.

The learned AGP informs us that the impugned order is acted upon and the Respondent was reinstated. Thereafter the Respondent is superannuated on 31 January 2020. Therefore, challenge to the order of the Tribunal which set aside the order of suspension does not survive for examination as of today. 5.

Therefore, without going into the merits of the matter, as the petition itself has become infructuous as the impugned order is already acted upon, writ petition is disposed of. (MANJUSHA DESHPANDE, J.) (NITIN JAMDAR, J.)
