1] Heard the learned Counsel for the parties. This application is preferred by Mohan Shetty, defendant No.2 for appointing him as a guardian for applicant No.5 Sanath P. Shetty on the ground that he is mentally retarded. To that effect, the applicant has placed on record a certificate issued by Sir J.J.Group of Hospitals, Byculla dated 22nd May 2013 and 3/3/2015 along with additional affidavit dated 18th March 2015.

2] Considering the submissions made by the learned Counsel for

YBG caf767-13 the applicant and the averments made in the civil application so also the medical certificate dated 22nd May 2013 and 3/3/2015, I am satisfied that the applicant has made out a case for allowing the civil application. Hence, the following order:- (a) Applicant No.2, Mohan Shetty is appointed as Guardian for applicant No.5 Sanath P. Shetty in the present proceedings; (b) Liberty granted to the appellant in F.A.961 of 2010 to carry out appropriate amendments to that effect within six weeks from today.

(c) Civil application is disposed of accordingly. ( K.K.TATED, J.)
