Office noting shows that as spare copy was not supplied by the Advocate for the Petitioners within stipulated time, notice could not be issued to the Respondent No.3.

Learned counsel for the Petitioners undertakes to supply a spare copy in the Registry, on or before 14.09.2016, so as to enable the Registry to issue notice to the Respondent No.3.

If the spare copy is supplied within the stipulated time, notice be issued to Respondent No.3, returnable on 28.09.2016.
Learned APP waives notice on behalf of the Respondent Nos.1 & 2 - State. In addition to Court notice, Advocate for the Petitioners, to serve the Respondent No.3 by Advocate's notice and file an Affidavit of service before the returnable date.

It is made clear, that if the spare copy is not supplied in the Registry, within the stipulated time, the Petition shall stand dismissed for non-prosecution without further reference to the Court.
