This is an application for condonation of delay in preferring the revision application challenging the Order passed by the Appellate Court.

Heard the learned Advocate appearing for the applicant/original accused. Similarly, I have also heard the learned Advocate appearing for the respondent No.2/original Gaikwad RD 1/2

(15)APPRNo.5912016 complainant. He opposed the application by contending that there is no sufficient cause for condoning the delay. I have carefully considered the rival submissions. The application is on affidavit. The duly sworn affidavit reflects sufficient cause for not preferring the revision petition within limitation. The delay occasioned is only of 59 days and the same is properly explained. Hence the Order :

ORDER

(i) The application is allowed.

(ii) The delay in preferring the revision application is condoned.
