The applicant is seeking pre-arrest bail in Crime No.110 of 2016 for the offence punishable under Sections 498A, 406, 323, 504, 506 read with Section 34 of IPC. the learned counsel for the applicant submits that custodial interrogation is not necessary for the reasons that all the family members of the applicant/husband are implicated in a false crime. According to him, sridhan is already returned. Substantial investigation in the matter is already over.
The learned APP who is assisted by Mr. Bansode, the learned counsel for the Complainant opposed the application on the ground that the investigation is in progress. Shivgan 1/2
910-ABA-1826-2016 Bestowed my thoughts to the submissions made, sridhan is already secured in the present case from the applicant. It is out of matrimonial discord, the complaint appears to be initiated against all the family members of the applicant including his married sisters. In my opinion, custodial interrogation is not called for. The application is allowed. Hence, the following order:
(1) In the event of arrest, the applicant shall be released on his executing PR Bond in the sum of Rs.20,000/- with one or more sureties in the like amount.
(2) The applicant shall attend the Investigating Officer as and when called.
(3) The applicant shall not influence the witnesses and/or tamper with the prosecution case.
