The learned counsel for the Appellant, after taking instructions from his client, seeks permission to withdraw the appeal with liberty to prefer an appropriate Application before the Municipal Corporation for regularization of the suit structure. To that effect, he made an endorsement on the farad.

Hence, the First Appeal as well as the Civil Application stand dismissed as withdrawn with liberty as prayed for.

If the Appellant files an Application within 4 weeks from today, the Municipal Corporation is directed to decide the same as early as possible but in any case within 8 weeks thereafter.
