IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.13490 OF 2016 Shiv K Agrawal : Petitioner.

versus Mrs. Sarita Agrawal : Respondent.

Mr. K M Mhatre for the Petitioner.

CORAM :

R. M. SAVANT, J.

DATE :

23rd January 2017 P.C.

The order dated 13/04/2016 directing the parties to produce documents regarding their financial status is taken exception to by way of the above Writ Petition. It seems that the Petitioner has filed an application for interrogatories.

The cause for filing the application appears to be the application filed by the Respondent herein for directing the Petitioner to produce documents under Order XI Rule 14 of the Code of Civil Procedure in which various documents are mentioned in paragraph 3 of the said application. It seems that to counter the said application, the Petitioner had filed the said application for interrogatories on 13/04/2016. The Trial Court on the same day i.e. on 13/04/2016 has passed the impugned order directing the parties to produce documents regarding their lgc

(38) wp-13490.16 financial status. The proceedings are at the stage where the application for interim maintenance filed by the Respondent wife is under consideration. Though a host of documents have been mentioned in the said application filed by the Respondent wife, the Trial Court has only stated that both the parties may produce the documents as regards their financial status. Hence the Trial Court has given a fair opportunity to both the parties. Considering the fact that the application for interim maintenance is to be adjudicated on the basis of the application and reply and also on the basis of the supporting documents in respect of which the Trial Court may arrive at its own conclusions, no case for interference is made out. The above Writ Petition is accordingly dismissed. [R.M.SAVANT, J] lgc
