The learned counsel for the Applicant/Appellant submitted that the valuation of the suit is Rs.14,48,000 /- i.e. below Rs.1 Crore. Therefore, he prays that this Appeal needs to be transferred to Additional District Court, Kalyan, in view of the notification issued by Law and Judiciary Department dated 31st August, 2015. 1/2

As per the Notification No.CCS.2014/C.R.-25/D-19, dated 31st August, 2015, the suits having valuation upto Rs.1 Crore are to be transferred to District Court with effect from 1st September, 2015. Hence, this Appeal be transferred to Additional District Court, Kalyan. Earlier order, if any, to continue till then.

The Registrar (Judicial) hereby directed to transfer this Appeal from Order alongwith Civil Application till 30th September, 2015 to the Additional District Court, Kalyan.

The parties are directed to remain appear before the learned Additional District Judge, Kalyan on 5th October, 2015. 5.

The Appeal from Order and Civil Application are disposed of as transferred.

6.

The Writ Petition No.1600 of 2015 between the parties shall be placed before the appropriate bench.
