This is the 2nd bail application filed by the Applicant who is facing trial in NDPS Special Case No.1076/2022 pending on the file of Special Judge (N.D.P.S.), City Civil and Sessions Court, Greater Mumbai arising out of C.R.No.18/2022 registered with ANC Azad Maidan Unit, Mumbai. The previous application being Bail Application No.184/2023 was argued at length and was withdrawn when this Court expressed disinclination to grant relief.

The only change in circumstance which is sought to be contended by the learned counsel for the Applicant is that there is no progress in trial. The Applicant was arrested on 16/03/2022. The Special case is 1/2

P.H. Jayani 16 BA2867.2023.doc of the year 2022. The mere fact that the trial has not commenced since last 07 months would not be a ground to release the Applicant on bail particularly considering the embargo under section 37 of the NDPS Act. Hence, the Application is dismissed.
