This is an Application under Section 439 of Cr. P.C. for bail in CR No. 310 of 2016 registered with Dattawadi Police Station, District - Pune under Sections 302, 143, 147, 148 & 149 of the Indian Penal Code.

Learned counsel for the Applicant submitted that coaccused - Durgesh Dilip Humbare, who has been attributed with same and/or similar role and circumstances in the present crime has been released on bail by this Court vide Order dated 13.09.2017 and therefore, the Applicant is entitled to be released on bail on the ground of parity.
Learned APP fairly submitted that the principle of parity is applicable in the present case.

Perused the charge-sheet. It clearly appears that the circumstances propounded against the Applicant by the prosecution are same and/or similar to that of co-accused who has already been released on bail by this Court vide Order dated 13.09.2017 and therefore, the Applicant is entitled to be released on bail on the ground of parity. Hence, the following Order:
(i) The applicant be released on bail in CR No.310 of 2016 registered with Dattawadi Police Station, Pune on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount;
(ii) After his release from Jail applicant shall attend the Dattawadi Police Station, Pune on every 1st and 3rd Monday of the month between 11.00 a.m. to 2.00 p.m.;
(iii) Applicant shall attend all the dates before the Trial Court; (iv) Any two consecutive defaults in complying with the aforesaid conditions, shall attract the provisions of cancellation of bail; (v) Applicant shall not tamper with the evidence and/ or influence the prosecution witnesses.
