Learned Counsel appearing for the Petitioner has placed on record a copy of the order dated 17-10-2014 of the Mumbai Building Repairs & Reconstruction Board, whereby the Petitioner is held not be a tenant. 2.

In view of aforesaid order dated 17-10-2014, the learned Counsel for the Petitioner fairly concedes that nothing survives for consideration in the present Petition. He seeks liberty to challenge the aforesaid order dated 17-10-2014 of the Mumbai Building Repairs & Reconstruction Board. 3.

We dismiss of the Petition with liberty as prayed. The order dated 25-01-2019 of this Court directing the Respondent No.1-Developer to pay the arrears of rent shall stand recalled.
