Additional affidavit of the petitioners, tendered in Court by Mr. Raichandani, learned advocate for the petitioners, shall be retained with the records. 2.

Having heard Mr. Raichandani and Mr. Dube, learned advocate for the respondents on the merits of the rival claims and considering prayer clause (c) of the writ petition, we dispose of the same by directing the respondent no. 3, i.e., the Additional Director General of Foreign Trade, Government of India to consider the grievance of the petitioner in respect of the impugned public notice dated December 6, 2021, as expressed in the representation

16.wp.8947-21 dated December 11, 2021 [being Exhibit 'A' to the additional affidavit], and dispose of such grievance in accordance with law as early as possible, preferably within a fortnight of receipt of a copy of this order together with a copy of the said representation. Needless to observe, a reasoned order shall be passed by the respondent no.3 if the said representation is rejected.

All contentions are left open.

There shall be no order as to costs.
