DATE : NOVEMBER 19, 2018 Since the appellant has challenged the order permitting the plaintiff to amend the plaint and add a party as proposed defendant, the present appeal under provisions of Order XLIII Rule (1) of the Code of Civil Procedure, 1908 would not be maintainable. The learned counsel for the appellant seeks permission to withdraw the appeal with liberty to file appropriate proceedings.

Appeal is permitted to be withdrawn with aforesaid liberty. Pending Civil Application St. No.27382 of 2018 also stands disposed of.
