The grievance of the petitioner is that though he had filed an application under section 28A of the Land Acquisition Act, the same has not been decided by the respondent no. 3 as yet. The respondents have filed reply. In the reply, it has been stated that it is the petitioner is avoiding his presence to record the evidence. Learned counsel for the petitioner submits that the petitioner has never received intimation about the presence before the said authority. He however, submits that the petitioner shall remain present before the competent authority on 16.1.2017 at 11.am so

33-wp-12658.2015.sxw that the matter can proceed further before the said authority. Learned AGP submits that in case the petitioner appears before the said authority on that date, the authority shall proceed with the matter in accordance with law and shall decide the petitioner's pending application as expeditiously as possible. 3.

In view of the aforesaid, we dispose of this petition by directing the petitioner to appear on 16.1.2017 at 11 am before the competent authority and thereafter the authority shall decide the petitioner's representation as expeditiously as possible but not latter than within three months from the date of the appearance of the petitioner. Petition is disposed of.
