The applicant is seeking pre-arrest bail in Crime No.116 of 2016 for the offence punishable under Section 306 of IPC. The applicant is a married woman. There is hardly any material on record to infer that it was within the knowledge of the present applicant that her conduct (of having relation with the deceased) will result into his committing suicide. In the absence of any motive and the fact that it was not within the knowledge of the applicant as regards the intention of the victim to commit suicide, application needs to be allowed. The application is allowed. Hence, the following order:

(1) In the event of arrest, the applicant shall be released on her executing PR Bond in the sum of Rs.50,000/- with one or two sureties.

911-ABA-1830-2016 (2) The applicant shall attend Kalyan Taluka police station on 2nd and 5th December,2016 between 10 a.m. to 12 noon and thereafter as and when called.

(3) The applicant shall not influence the prosecution witnesses.

(4) The applicant shall not tamper with the prosecution evidence.
