This is an application seeking condonation of delay of 124 days in preferring an appeal against the judgment and award dated 3rd February 2017 passed by the Motor Accident Claims Tribunal, Kolhapur, avk 1/3

in Motor Accident Claim Petition No.106 of 2010. Mr.Modak, learned counsel for the Applicants/Appellants, draws the attention of this court to paragraph 7 of the application in support of his contention to condone the delay. The Respondents have been served. Mr.Diwan, learned counsel for Respondent No.1 has no objection if the application is allowed. None appears for Respondents no.2 and3 though served. 2.

Having heard the learned counsel and having perused the application, let the delay of 124 days be condoned. Let the First Appeal be registered. The application stands disposed. FIRST APPEAL (ST) NO.28433 OF 2017 3.

List the First Appeal for Admission on 19th July 2023, subject to removal of all office objections.
