By an order dated 19.10.2016, the applicants are granted interim relief. The record reveals that the applicants are landlords/owners of the premises which was given to the tenants/co-accused on rent and a leave and license agreement has been duly executed in that behalf. It is the prosecution case that the tenants/co-accused have committed theft of electricity from the electricity meter provided to the said tenements. Coaccused, namely, Amol Baragya, Satish Chandrakant Chavan and Sanjay Shah, the tenants were already arrested and have been released on bail by the Trial Court. After perusing the record of investigation, this Court is of the view that the custodial interrogation of the applicants is not necessary.

Hence, the interim order granted on 19.10.2016 is hereby confirmed. However, the condition to attend the Investigating Officer is hereby waived.
