1) Respective counsel, after arguing for sometime, upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Needless to say that the interim relief stands vacated. 2) Respective counsel submit that the accused are public servants and that they would appear before the concerned Sessions Court on or before 27/12/2016. The learned Sessions Judge hearing applications under section 439 of the Code of Criminal Procedure, 1973 filed by the present applicants is hereby requested to make an endeavour to hear the applicants, Public Prosecutor, peruse the documents and decide the applications on merits, preferably within a period of one week from the date of filing of the application. The learned Sessions Judge shall decide the application on merits, without being influenced by the withdrawal of the present applications. 3) Applications stand dismissed as withdrawn.
