Heard Mr. Patil, learned counsel appearing for the Petitioner and Mr. Vanarase, learned AGP appearing for Respondent No. 2 - State.

Mr. Patil, learned counsel appearing for the Petitioner states that by the impugned order dated 24.05.2023, the Petitioner's license to construct Pharmaceutical shop has been suspended by the Assistant Commissioner, Food and Drugs Administration, State of Maharashtra. He states that the Petitioner has fled an Appeal before the Hon'ble Minister, Food & Drugs Administration, State of Maharashtra and that the hearing in the said Appeal is completed on 04.09.2023.

Mr. Vanarase, learned AGP appearing for Respondent No. 2 states that the order is almost ready and it will be delivered on 29.09.2023.

In view of the said statement made by the learned AGP, nothing survives for consideration in the present Petition. Accordingly, the Writ Petition is disposed of. 5.

It is clarifed that this Court has not considered this Petition on merits and all the contentions are expressly kept open.
