This court has heard the counsel for the applicant at length. As this court was not willing to show indulgence, the learned counsel for the applicant on instructions made a prayer for withdrawal of revision application. The revision application stands dismised as withdrawn.

However, as prayed by the learned counsel for the applicant on instructions time till 31st May, 2023 is granted to surrender the possession of the suit premises subject to following conditions:

(a) That within forth night the applicant shall furnish an undertaking alongwith other occupants of the suit premises to

HRN 2/2 34 cra 22-2020.doc this Court that they shall be surrendering possession in any case by 31st May, 2023. Till such period, the applicant undertakes to maintain suit premises in good habitat condition. 3.

Till premises are vacated as undertaken, the applicant shall clear entire arrears of rent and other dues as are payable. The undertaking if not furnished, it shall be open for the learned counsel for the decree holder to execute the decree. (NITIN W. SAMBRE, J.)
