CIVIL APPELLATE JURISDICTION WRIT PETITION NO.11399 OF 2017 Ananta Mahadu Dalvi ... Petitioner.

CORAM : Smt.Vasanti A Naik & Riyaz I. Chagla, JJ.

DATE : 10th October, 2017.

P.C. :

Not on board. Taken on board.

By this petition, the petitioner challenges the order of the election officer dated 03.10.2017, accepting the nomination form of the respondent no.4 for election to the post of Sarpanch. According to the petitioner, the nomination form of the respondent no.4 should not have been accepted by the election officer as the name of the respondent no.4 does not find a place in the electoral roll.

Sudhir Rane 507-WP-11399-2017 We are not inclined to interfere with the election process at the intermediary stage. The election is scheduled on 16.10.2017. The last date for filing of nomination and scrutiny of the forms is over. If the petitioner is of the view that the respondent no.4 is wrongly permitted to contest the election in view of the wrongful acceptance of his nomination papers, the petitioner can as well file an election petition after the election is concluded. In the circumstances of the case, we decline to entertain the writ petition, at this stage. The writ petition is disposed of with no order as to costs. The points raised in the writ petition are kept open.
