Respondent No. 2- Diwakar expired on 17/04/2017. Copy of the death certificate is annexed. The Appellant got knowledge about the death when there is a report of the bailiff. That is why there is a delay of 1616 days. Service of the Court notice is awaited. But the Appellant has served the proposed Legal representatives by way of private service. Affidavit is filed on record. There is no appearance. In view of that application is allowed in terms of prayer clauses- a, b and c. 3.
