Mr. Mandlik has tendered praecipe dated 12.8.2015 for withdrawal of this Writ Petition on the ground that the parties have settled the matter. The praecipe is taken on record and marked "X" for identification. Ms. Singh has

2 / 2 WP/ 9492 /2010 tendered photocopy of the order dated 24.7.2015 passed by this Court along with Minutes of order in Company Appeal No.25 of 2009. She submitted that in terms of clause (viii) of Minutes of the order, by consent, the petitioners herein have agreed to withdraw the writ petition. The order dated 24.7.2015 along with Minutes of Order, by consent, are collectively taken on record and marked "Y" for identification.

In view thereof, on the motion made by Mr. Mandlik, Petition is allowed to be withdrawn and is disposed of as such.

In view of withdrawal of Petition, Civil Application No.402 of 2013 for issuing fresh notice to respondents no.1 and 2, Civil Application No.1626 of 2014 for producing original agreement of Partnership dated 9.3.1995, do not survive and the same are disposed of.
