By this petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, the petitioner seeks appointment of a sole arbitrator under clause 4.10 of the work order dated 6th January 2010. There is no dispute that the arbitration agreement exists between the parties.

The parties have suggested the name of Shri Justice D.G. Karnik, former Judge of this Court as a sole arbitrator. Learned proposed arbitrator has filed his disclosure dated 14th April 2016 under Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996 pursuant to the order passed by this Court on 18th March 2016. The disclosure filed by the learned proposed arbitrator is taken on record and is accepted. Shri Justice D.G. Karnik, former Judge of this Court is appointed as a sole arbitrator. By consent of the parties, the learned arbitrator may decide the venue/place of arbitration. Arbitration petition is disposed of aforesaid terms. No order as to costs. R.D. DHANUKA, J.
