1) Heard learned counsel for the applicants. Also heard the learned APP for the State. This is an application for bail/ suspension of substantive sentence filed by the applicants/ accused during pendency of the appeal. Today the appeal is admitted.
2) Applicant no.1 is convicted for the offences punishable under section 7 and 13 (1)(d) read with section 13 (2) of the Prevention of Corruption Act,1988. He is sentenced to suffer RI for one year on each count. Applicant No.2 is convicted for the 1/2
902-APPA-1334-2015.doc offence under section 12 of the Prevention of Corruption Act and sentenced to suffer RI for six months. Some fine amount was also imposed on him. Reportedly, fine amounts are paid as stated by the learned counsel for the applicants. 3) During the trial, both the applicants were on bail. Even after their conviction they are on bail till filing of the appeal. As such considering these circumstances both the applicants shall be released on same bail as granted by the trial Court with fresh bonds to be executed before the trial Court. The order granting bail to the applicants shall be effective only after the payment of entire fine amounts imposed against them.
4) Criminal Application for bail and suspension of sentence is accordingly disposed of.
