The learned Counsel for the Petitioner submits that the validation proceedings is pending with Respondent No.2 Committee since the year 2012. Vigilance was also completed. The Petitioner has filed say to the vigilance report however, the proceedings are not decided. The Petitioner is not paid salary from 1st August 2011 to April 2018. The Petitioner was given approval as Shikshan Sevak on 1st August 2008 till 31st July 2011. The proposal is submitted by the Management for the permanent approval to the Petitioner, however, the same is not decided only on the ground that the Petitioner has not produced validity certificate.

a.

The Petitioner shall appear before the Scrutiny Committee on 24th November 2022.

b The Committee shall endeavour to decide the validation proceedings in respect of the caste claim of the Petitioner, expeditiously, preferably within four months from the date of appearance of the Petitioner.

c If the proposal for permanent approval of the Petitioner is not with the Education Officer the Management shall forward the proposal afresh within two weeks from today seeking approval to the appointment of the Petitioner as an Assistant Teacher. The decision shall be taken on the same by the Education Officer. The said decision of approval shall be subject to the decision that would be taken by the Scrutiny Committee in the validation proceedings.

d The Management shall also submit the salary bills of the Petitioner for the period 1st August 2011 till 31st March 2018 to the Education Officer which the Education Officer shall process in accordance with the law within four weeks from the date of submission of the salary bills by the Management. e The Writ Petition is disposed of.
